No refunds, cancellations or exchanges will be issued for date or time changes, partial performances, or loss. All Sales are Final.

By attending, you hereby consent to and authorize the filming, photography, and recording of your likeness, voice, activities and performances during the event. You understand and agree that the festival and its affiliates have the unrestricted right to use, reproduce, distribute, and exhibit any such recordings, in whole or in part, for any purpose whatsoever, including but not limited to promotional and documentary purposes, without compensation. You release the festival and associates from any liability associated with the use of such recordings.

I agree to Waiver RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISKS and INDEMNITY/HOLD HARMLESS AGREEMENT for use of The Westcott INC, 1. Defined terms under this Agreement: "Owner" –The Westcott INC" Users" - shall mean by answering “YES” below Minors, heirs, successors, representatives and assigns. "Minors" - shall mean the following minors who are the children, foster children, wards or otherwise legal responsibility of the Parent/Guardian Users. "Released Parties" - shall mean the Owner, The Westcott INC" Property" - shall mean the The Westcott Theater located at 524 Westcott St. Syracuse, NY 13210. 2. The undersigned Users do hereby execute this Release, Waiver of Liability, Assumption of Risks and Indemnity/Hold Harmless Agreement (the "Agreement") for themselves and their heirs and any of their Minors, guests and invitees and acknowledges the inherent risks involved in the use of the Owners’ Property, which risks include, but are not limited to bodily injury, or death. 3. Users acknowledge and agree that a Parent/Guardian shall be always present to accompany and supervise their minor child and/or children. The Parent/Guardian Users assume all responsibility for the supervision, safety and welfare of their minor child or children while upon the property. 4. In exchange for being permitted to use the property the undersigned Users release and agree not to make or bring any claim of any kind against the Released Parties (Owners) for: (1) any injury (including death), disease or sickness to Users, Minors or their guests and invitees. (2) any damage to personal property whether or not caused by the negligence of the Released Parties or not; or (3) any other cause arising out of or related to visit Parent/Guardian, Users, Minors or their guests and invitees. 5.In consideration for being allowed to use the property under this Agreement, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged: Users AGREE TO INDEMNIFY AND HOLD THE RELEASED PARTIES (Owners) HARMLESS FROM LIABILITY OR CLAIMS, DEMANDS, DAMAGES AND COSTS FOR OR ARISING OUT OF: (1) ANY DAMAGE, INJURY, DISEASE, SICKNESS OR DEATH TO USERS OR THEIR MINORS, GUESTS OR INVITEES RELATED TO THE USE OR OPERATION OF THE Property; OR (2) ANY DAMAGE OR LOSS TO PERSONAL PROPERTY CAUSED BY OR RELATED TO THE USE OR OPERATION OF THE Blue Hole. USERS UNDERSTAND, ACKNOWLEDGE AND STIPULATE THAT THIS INDEMNITY AGREEMENT INCLUDES ANY SUCH CLAIMS, DEMANDS, DAMAGES AND COSTS ARISING OUT OF NEGLIGENCE ON THE PART OF THE RELEASED PARTIES (Owners). 6. Users stipulate and agree that invalidation of any term(s) or provision(s) of this Agreement by judgment or other court order shall not affect any of the other terms or provisions and such other terms and provisions shall remain in full force and effect. 7. Users agree that they will be responsible for any and all legal fees incurred by the Owners for any proceeding or action brought under or with relation to this Agreement. 8. This waiver covers users and owner for all days you are present on the property.
